MODELO DE CLÁUSULA COMPROMISSÓRIA

Qualquer litígio, controvérsia ou demanda oriunda ou relativa a este contrato, ou o descumprimento, a rescisão ou a invalidade deste, será resolvida por arbitragem, de acordo com as Regras de Arbitragem da UNCITRAL, tal como vigentes no presente momento e sob administração da Câmara Imobiliária de Mediação e Arbitragem – CIMA.
Nota – As partes podem querer considerar acrescentar o seguinte:
(a) A autoridade designadora será a Câmara Imobiliária de Mediação e Arbitragem – CIMA;
(b) O número de árbitros será ............. (um ou três);
(c) O local da sede da arbitragem será ................. (Cidade ou País);
(d) O(s) idioma(s) empregado(s) no procedimento arbitral será (ão).......

MODEL ARBITRATION CLAUSE

Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the UNCITRAL Arbitration Rules as at present in force and under administration of Câmara Imobiliária de Mediação e Arbitragem - CIMA.
Note - Parties may wish to consider adding:
(a) The appointing authority shall be Câmara Imobiliária de Mediação e Arbitragem;
(b) The number of arbitrators shall be ... (one or three);
(c) The place of arbitration shall be ... (town or country);
(d) The language(s) to be used in the arbitral proceedings shall be ...

CLÁUSULA-MODELO DE CONCILIAÇÃO

Caso advenha uma controvérsia oriunda ou relativa a este contrato, se as partes desejarem buscar uma composição amigável de tal controvérsia por meio de conciliação, a conciliação ocorrerá de acordo com as Regras de Conciliação da UNCITRAL, tais como vigentes no presente momento e sob administração da Câmara Imobiliária de Mediação e Arbitragem – CIMA. (As partes podem escolher outras cláusulas de conciliação.)

MODEL CONCILIATION CLAUSE

Where, in the event of a dispute arising out of or relating to this contract, the parties wish to seek an amicable settlement of that dispute by conciliation, the conciliation shall take place in accordance with the UNCITRAL Conciliation Rules as at present in force and under administration of Câmara Imobiliária de Mediação e Arbitragem – CIMA. (The parties may agree on other conciliation clauses.)
